FISA Section 702 Expired Friday. Trump Now Wants Voter ID Legislation Attached Before He Supports Renewal.

Since Congress last granted a temporary extension of Section 702 in April, the program has expired again — this time with no replacement deal in sight as of June 15, 2026.

What Section 702 Actually Does

Section 702 authorizes U.S. intelligence agencies to collect communications from non-American targets located outside the country without a warrant. The catch, documented by the government's own Privacy and Civil Liberties Oversight Board in a 2023 report, is that the program "inherently and intentionally" sweeps in Americans' communications as incidental collection. The PCLOB's words, not an advocacy group's.

The Electronic Frontier Foundation's Matthew Guariglia has called for a warrant requirement before the FBI can query any American's communications pulled under 702. The Cato Institute filed a FOIA lawsuit in 2024 specifically to find out how often the powers are abused, and that information remains undisclosed according to Reason.

Trump's Conditions

Trump posted on Truth Social Sunday afternoon and again early Monday morning making his position explicit. No FISA renewal without the SAVE America Act attached, in full.

The SAVE America Act would require government-issued ID and proof of citizenship to register or vote in federal elections. It would also ban mail-in ballots, bar biological males from competing in women's sports, and prohibit gender transition procedures for minors. Trump is not just asking for one thing. He's bundling several of the most contested policy debates of the last five years into a single surveillance reauthorization bill.

According to the Daily Signal, Rep. Julie Fedorchak, R-N.D., plans to introduce a companion bill this week called the "SAVE America Through REAL ID Act," which would create a federal grant program encouraging states to require REAL IDs at the ballot box.

Trump's own framing on Truth Social acknowledged his prior skepticism of 702: "The Dumocrats want FISA because that's what they used to go after me for three years during my First Term!" In 2024, Trump was publicly demanding Congress "KILL FISA" after reports of government surveillance targeting his campaign. He now controls the executive branch and the surveillance apparatus that runs 702. His position has shifted considerably since then, as Reason noted.

The Democratic Angle

Democrats had their own leverage play running simultaneously. According to the Daily Signal, they signaled they would block any FISA extension until Trump named a confirmed, Senate-approved director of national intelligence rather than an acting one. Trump had tapped FHFA director Bill Pulte to serve as acting DNI after Tulsi Gabbard resigned to care for her husband. Both parties pushed back on Pulte. Trump subsequently announced Jay Clayton as his formal nominee for the role, but Clayton has not yet been confirmed.

The Strongest Case for Letting 702 Expire

The civil libertarian argument is direct and not fringe: Section 702 has been used to conduct warrantless queries of Americans' private communications. The government admits this. The PCLOB said so in writing. The FBI has a documented history of misusing the tool — a 2022 court ruling found hundreds of thousands of non-compliant searches. Reformers argue that an expiration forces Congress to actually fix the warrant gap rather than keep kicking the can. EFF's Guariglia said plainly that expiration is preferable to renewal without a warrant requirement. That is a coherent position, not panic.

DHS Secretary Mullin pushed back on Fox News Sunday, saying the terrorism threat level is "the highest it's ever been" and that while alternatives exist to 702, losing it "makes it significantly more difficult" to act quickly against threats.

The Complication Nobody Wants to Say Out Loud

Republicans control both chambers of Congress. This is not a situation where Democrats are solely blocking renewal. Bipartisan concern about 702's reach has existed for years. Some of Trump's most vocal FISA critics in 2024 were Republicans. The current deadlock involves GOP members skeptical of Pulte as acting DNI, Democratic demands for a confirmed nominee, and Trump's demand to attach unrelated legislation. That is a three-way tangle inside a party that holds the majority.

Voter ID itself is a defensible policy position. Requiring identification to vote is no different in principle from requiring it to board a plane or open a bank account. Polls consistently show majority support for the concept. But attaching it to a surveillance bill is a legislative tactic, not a governing strategy, and it risks either killing the security tool or forcing through the voter ID provisions without the deliberate floor debate they would otherwise require.

Where Things Stand

As of June 15, Section 702 is lapsed. Jay Clayton has been nominated as DNI but not confirmed. Rep. Fedorchak's REAL ID voting bill has not yet been introduced. The Cato Institute's FOIA lawsuit seeking data on 702 abuse frequency remains unresolved.

The unresolved question with the most direct consequence: if a terrorism-related communication is collected in the coming days and an attack occurs, who owns the legal and political fallout — the Democrats who stalled, Trump who added new conditions, or the bipartisan coalition that has refused for years to pass clean reforms with actual warrant protections?
