The Scheme

According to the Justice Department, cited by the Daily Wire, Rivera and political consultant Esther Nuhfer secured a $50 million contract with PDV USA, a New York-based affiliate of Venezuela's state oil company PDVSA, between 2017 and 2018. Prosecutors say they used that commercial arrangement as cover to lobby Republican officials, including then-Senator Marco Rubio and Representative Pete Sessions of Texas, both of whom testified at trial that Rivera never disclosed the Venezuelan money behind the outreach.

Rivera was recruited by then-Venezuelan Foreign Minister Delcy Rodríguez, who has since served as Venezuela's Vice President, to push the first Trump administration toward normalizing relations with Caracas, according to the AP reporting carried by PBS, Fortune, and the Anchorage Daily News. That effort collapsed within months when the administration instead imposed sweeping sanctions on Maduro's government.

Trial evidence showed Rivera built an encrypted messaging group called "MIA" with code names for everyone involved. Maduro was "the bus driver," Sessions was "Sombrero," Rodríguez was "the Lady in Red," and Rubio, whose surname translates to blond, was called "Miss Clairol," according to Breitbart and a separate account from nile1. Money was referred to as "melons" or "La Luz."

Prosecutors traced the money. Rivera directed $1.5 million from the contract into his own campaign account between March 2017 and August 2018, according to the Daily Wire. A separate $3.75 million wire went to a South Florida company that maintained a yacht owned by Venezuelan media mogul Raúl Gorrín, Rivera's main conduit to the Maduro government, according to nile1. What Rivera's Defense Argued

Rivera's lawyers, according to the Epoch Times, argued the consulting contract was with PDV USA, a commercial subsidiary, not the Venezuelan government directly, and that foreign agent registration law carries an exemption for ordinary business work. They said Rivera's actual job was helping Citgo operate in the U.S. and encouraging political change inside Venezuela, not secret political lobbying. Prosecutors countered with evidence from a related civil case showing Rivera did little of the contracted business work and instead used the deal as a shield for illegal lobbying.

Rivera himself denied being, in his words, a two-faced grifter. In a 20-minute statement, he described a childhood without a father in an immigrant Miami neighborhood and a career "fighting the good cause," and asked for leniency, citing his age and a past battle with prostate cancer that he said made a long sentence a "death sentence," according to Fortune and the Anchorage Daily News.

Nuhfer, his co-defendant, was sentenced in August to five years, according to the Epoch Times.

What's Still Pending

Jurors also ordered forfeiture of properties Rivera owned in Doral and the Florida Keys, CBS News reported. Judge Damian still has to rule on a separate government request that Rivera forfeit $20 million in alleged criminal proceeds.

Rivera's attorneys plan to appeal and applied in June for a presidential pardon, according to Breitbart. He also still faces a related federal foreign-lobbying case in Washington, D.C.

Rivera was indicted in 2022, under the Biden administration. The AP noted that prosecutions for illegal foreign lobbying have dropped sharply since President Trump returned to office. Rubio, now secretary of state, and Sessions both testified against their former friend and ally. Neither has been charged with any wrongdoing, and no evidence in the record suggests either man knew where the money was coming from.

The open question now is whether the Justice Department, under an administration Rivera once lobbied for, will see a pardon request through, and whether Damian orders the full $20 million forfeiture prosecutors want.
