Whistleblower Alleges USPS Defied Court Orders To Rush Trump's Mail-Ballot Screening System

A whistleblower report released Tuesday by Sen. Richard Blumenthal (D-Conn.) alleges the U.S. Postal Service kept building a new mail-ballot screening system even after federal judges twice ordered it to stop, and did so on a rushed timeline aimed at a September 1 launch, today's date.

The complaint, prepared by the nonprofit Whistleblower Aid and identified only as coming from a federal official with direct knowledge of the project, describes the system as the "USPS Federal Ballot Mail Portal." States would upload lists of eligible mail voters. USPS would check ballots against those lists before mailing them out, and reject any that don't match.

According to the whistleblower, the system is built on what it calls a "zero percent failure rate" standard: in a batch of 10,000 ballots, if a single barcode fails to scan or a single name doesn't match the list, the entire batch gets kicked back to the state. The report warns that could mean "potentially millions" of voters never receive a ballot in time.

How we got here

The project traces to a March 2026 executive order from President Donald Trump directing federal agencies to restrict mail voting, including having USPS regulate absentee-ballot design and check voters against approved lists. USPS started building the portal in June.

On June 25, U.S. District Judge Indira Talwani, an Obama appointee, blocked USPS from implementing the order in a case brought by 23 Democrat-led states and Washington, D.C., along with a separate nationwide injunction won by voting rights groups. Talwani ruled the order was "legally void," finding the Constitution assigns election administration to states and Congress, not the president, according to Democracy Docket.

The whistleblower alleges work on the portal quietly resumed around July 29, while Talwani's order was still in effect, according to USA Today.

On August 24, the Supreme Court's conservative majority lifted the block, ruling the challenge was premature because USPS hadn't yet finalized its rule. USPS then published a final mail-ballot rule, which the Epoch Times dates to August 21 and USA Today dates to August 26. Plaintiffs sued again immediately, and Talwani issued a fresh block on August 27. The whistleblower alleges USPS kept working on the portal anyway.

Blumenthal sent a letter to Postmaster General David Steiner on August 31 demanding USPS confirm whether it has actually halted work, who's building the system, and what testing, if any, is planned before rollout.

What's proven and what isn't

None of this has been verified by a court. The whistleblower's identity, credentials, and evidence haven't been made public beyond what Whistleblower Aid summarized for Blumenthal's office. USPS has not responded to requests for comment from the Daily Beast, USA Today, or Yahoo News as of this writing. Whether USPS actually violated Talwani's orders is now a live question for the litigation in front of her, not a settled fact.

The competing argument

House Speaker Mike Johnson, asked about the report Tuesday, said he hadn't read it but defended the broader push for tighter mail-ballot rules. "Is it a good idea to keep voting, keeping tally of the vote, counting votes a month after an election?" he told reporters, per Courthouse News, pointing to California's practice of processing late-arriving ballots. "It just gives the appearance of impropriety, and it opens the door for fraud."

Many voters share this genuine election-administration concern: ballots counted weeks after Election Day undermine public confidence even without proof of fraud, and voter-list verification is a mainstream integrity measure similar to ID requirements used elsewhere in civic life.

But the fraud data doesn't back the scale of the concern. The Heritage Foundation's own fraud database counts fewer than 400 mail-ballot fraud cases nationwide since 2000. Brookings Institution research found roughly four fraudulent mail ballots out of 10 million cast between 2016 and 2022, according to Courthouse News. Rare fraud doesn't mean zero risk, but it also doesn't justify a system that, by the whistleblower's account, could bounce entire 10,000-ballot batches over a single scanning glitch.

The White House has separately laid out a broader case for federal election-security controls, publishing what it says are declassified intelligence assessments alleging Russia, China, Iran and North Korea have the capability to compromise U.S. election infrastructure, and alleging China obtained 220 million voter files in a data breach. None of that documentation addresses the specific technical design of the USPS portal or the whistleblower's claims about court-order violations.

What's next

Blumenthal is waiting on Steiner's response. Talwani's August 27 injunction remains the operative order pending further proceedings, and the states' lawsuit over the final rule is ongoing. Whether the Federal Ballot Mail Portal actually went live on its reported September 1 target date, and whether USPS complied with the court order in doing so, remains unconfirmed by any independent source as of today.
