The unanimous three-judge panel found that Sandy Hook parents Neil Heslin and Scarlett Lewis did not present sufficient evidence that harassment stemming from Jones's hoax claims justified exceeding Texas's $750,000 statutory cap on damages per plaintiff, according to the Associated Press. With two plaintiffs, that cap works out to $1.5 million total.

Heslin and Lewis's six-year-old son, Jesse Lewis, was among 20 children and six educators killed when a gunman attacked Sandy Hook Elementary School in Newtown, Connecticut, in December 2012. Jones spent years telling his Infowars audience the massacre was staged by the government to justify gun control, and his followers harassed grieving families for it. A Texas jury found him liable in 2022, in what AP notes was the first time Jones was held financially responsible for those lies.
