North Carolina Teen Ordered Abortion Pills at 31 Weeks, Baby Born Alive on Toilet, Survives

An 18-year-old woman in Durham, North Carolina, took abortion pills ordered from out of state at 31 weeks of pregnancy, gave birth on a toilet, and the baby survived, according to court documents cited by Fox8 and reported by Breitbart News, LifeNews.com, and Live Action.

Syeisha Johnson and the baby's father, 19-year-old Elijah Speight, were arrested August 4, roughly a week after Durham police responded to a 911 call at their home on July 29.

Court documents state Johnson ordered mifepristone and misoprostol online from Virginia and took the drugs on July 26, "in an attempt to terminate her pregnancy early," according to a detective's account cited by LifeNews.com. The couple says they learned of the pregnancy in June, when a doctor told them Johnson was 20 weeks along.

Three days after taking the pills, Johnson went into labor. "Ms. Johnson began having abdominal pain and sat down during the day to help with the pain. She sat on the toilet and gave birth to a child," a detective wrote in the search warrant, according to LifeNews.com and Live Action.

The baby, born at 31 weeks and weighing under 5.5 pounds, was left in the toilet for several minutes before first responders arrived, according to the warrants. Officers found the newborn with a pulse, performed CPR, and transported the baby to Duke Medical Center for treatment. The abortion drugs were found in Johnson's purse, Live Action reported.

Johnson faces charges of assault inflicting serious bodily injury on an unborn child, and assault with a deadly weapon with intent to kill. Speight faces a charge of negligent child abuse inflicting serious bodily injury. Both appeared in Durham County court on Wednesday and were released after posting $1,000 bond each.

Durham County District Attorney Satana Deberry, an elected Democrat who has publicly supported abortion rights, said she has not yet reviewed the full evidence. "What I can say is that I have been on the record over and over again saying I believe a woman has the right to choose and has the right to make decisions about her own body, and we will review the evidence in this case in that light," Deberry said, according to LifeNews.com. She also said of the couple, "These two young people are not a danger to our community. It's important that they be with their families and be able to defend themselves appropriately."

Public Defender Barbara Lagemann pushed back on the idea that Johnson acted recklessly after the birth. "Miss Johnson did exactly what we would expect her to do, which is getting care for her child," Lagemann said, noting that Johnson called 911 herself and that neither defendant has a prior criminal record.

Calling for help after a medical emergency, rather than fleeing or hiding the baby, is the opposite of the behavior prosecutors typically point to when arguing for the harshest charges. Defense attorneys are also expected to argue that North Carolina law contains protections shielding pregnant women from certain prosecutions tied to their own pregnancies, which will likely be a central legal question as this case moves forward.

But the underlying facts are not in dispute. North Carolina law permits abortion only through 12 weeks of pregnancy, with narrow exceptions. Johnson was roughly 31 weeks along, in the third trimester, when she took the pills. The FDA's own labeling only recommends mifepristone and misoprostol for use up to 10 weeks of pregnancy. Johnson was more than three times past that window.

Babies born at 31 weeks have a 90% to 95% survival rate in general, and closer to 99% in advanced neonatal intensive care units, according to Live Action. This baby beat an already favorable survival window despite being left in a toilet for several minutes before help arrived.

The case sits at the center of an ongoing fight over telehealth abortion pill access. A Biden-era policy loosened FDA restrictions requiring in-person doctor visits before dispensing mifepristone, allowing the drug to be mailed across state lines with far less medical screening than before. Breitbart News points directly at that policy shift as a factor that let a woman more than seven months pregnant order the drugs from Virginia without ever seeing a doctor who could verify her gestational age or flag the obvious danger.

LifeNews.com and Live Action both frame the case as evidence that abortion pills can fail even at extreme gestational ages, with the baby surviving despite the drugs and the delivery method. Neither outlet, nor Breitbart, reports that Virginia or federal authorities have opened any investigation into the pharmacy or telehealth provider that shipped the pills across state lines. That remains an open question: who filled this order, what screening if any occurred, and whether any regulatory body will examine how a 31-week prescription got approved at all.

Deberry's office has not announced a timeline for deciding whether to proceed with the charges against Johnson and Speight.
