Virginia Rep. McGuire Introduces Bill to Codify Birthright Citizenship Limits, Following Kavanaugh's Statutory Roadmap

Rep. John McGuire (R-Va.) introduced the Birthright Citizenship Clarification Act of 2026, formally launching the statutory track that Justice Brett Kavanaugh outlined in his Trump v. Barbara opinion.

The legislation would define who qualifies for U.S. citizenship at birth and carve out statutory exceptions for children of parents who are unlawfully present in the United States or here on temporary visas, according to McGuire's press release. It would preserve existing long-recognized exemptions: children of foreign sovereigns, foreign public ship crews, and hostile occupiers would remain excluded, as they have been under prior law.

The bill was drafted with the Institute for Legislative Analysis (ILA), a data and policy group. ILA CEO Ryan McGowan said the goal was to translate Trump's original executive order objectives into statutory form, following Kavanaugh's instructions rather than pursuing a constitutional amendment, which McGowan called politically unrealistic. "Calls to fix this crisis through a constitutional amendment do not acknowledge political reality," McGowan said in the release. "This bill represents the most feasible path for conservatives to actually stop birth tourism and restore the proper meaning of American citizenship."

Kavanaugh's opinion in Trump v. Barbara was the bill's architectural blueprint. Kavanaugh found that the primary obstacle to changing birthright citizenship policy was existing federal statutes, not the Fourteenth Amendment itself, which means Congress, not the executive branch acting alone, holds the relevant authority. That framing handed congressional Republicans a legal theory: pass a statute, and it stands on firmer ground than an executive order.

Fred McGrath, president of the ILA, pointed to Justices Thomas, Alito, and Gorsuch, who argued Trump's original executive order was already consistent with the Citizenship Clause and the Supreme Court's 1898 precedent in United States v. Wong Kim Ark. "Justice Kavanaugh has made clear that Congress holds the authority to resolve the statutory conflict," McGrath said, according to Tampa Free Press. "By moving through Congress, the Birthright Citizenship Clarification Act directly addresses that concern."

Opponents of the bill will argue that Kavanaugh's statutory opening does not actually exist, that the Fourteenth Amendment's phrase "subject to the jurisdiction thereof" has been settled since Wong Kim Ark to include nearly all persons born on U.S. soil regardless of their parents' immigration status, and that a statute cannot override a constitutional guarantee. Supporters acknowledge legal scrutiny is coming. Their counter is that Kavanaugh's framing specifically opens the door to a statutory challenge distinct from the executive-order challenge, and that a new case with new posture could produce a different outcome.

McGuire is a Virginia Republican whose district covers central Virginia. Quiver Quantitative estimates his net worth at approximately $1.2 million as of July 9, 2026, ranking him 319th in Congress by wealth.

"American citizenship is a privilege, and an honor that must be protected," McGuire said in a statement. "For too long, foreign nationals have exploited the process of birthright citizenship through loopholes like birth tourism, devaluing what it means to be an American. My Birthright Citizenship Clarification Act safeguards the privilege of being a citizen of our great nation."

The Birthright Citizenship Clarification Act is the most concrete legislative text to emerge from the congressional debate over birthright citizenship following the courts' handling of Trump's executive order. Whether House leadership schedules the bill for markup remains the immediate open question.
