Musk Threatens to Sue Khanna Over DOGE-USAID Death Claim. No Lawsuit Filed Yet.

Khanna appeared on the "I've Had It" podcast on Saturday, June 21, and argued that Democrats must pursue accountability for Musk if they regain congressional power. "They're celebrating that he created 4,400 millionaires," Khanna said, "but they don't talk about the 4.5 million children around the world who he possibly sentenced to death by dismantling USAID."

Khanna did NOT claim 4.5 million children had already died. He said Musk "possibly sentenced" them to death, a projection rather than a body count. The number traces to a peer-reviewed study published by The Lancet in July 2025, which examined USAID's impact across 133 low- and middle-income countries and projected that continued funding cuts could lead to more than 14.1 million additional deaths by 2030, including 4.5 million children under five.

Musk's Response

On Monday, June 22, Musk posted "Time to sue this liar" on X, according to Fox News and Common Dreams. He followed with additional posts defending DOGE's methodology: "All DOGE did was require contact with the aid recipients to confirm that funds were being used legitimately."

He also linked to a 2025 Justice Department press release on a former USAID official who pleaded guilty to theft, arguing the oversight was necessary precisely because fraud existed. That guilty plea is documented fact, not allegation.

Musk then escalated, calling Khanna "Ro the Robber," accusing him of questionable stock trading practices, and writing that Khanna "should be in prison." Those accusations, directed at a sitting congressman, carry no supporting charges, indictments, or convictions. They are Musk's assertions.

The Defamation Problem Musk Faces

Any defamation suit would require Musk to prove Khanna made a false statement of fact. Khanna's statement was explicitly conditional—"possibly sentenced"—and sourced to a major peer-reviewed journal. Musk's underlying policy defense deserves a fair hearing. The USAID cuts were part of a broader Trump administration review. In March 2025, Secretary of State Marco Rubio announced the cancellation of 83% of USAID programs, approximately 5,200 contracts, after a six-week review, with remaining programs absorbed by the State Department, according to The Deep Dive. The administration's stated rationale was eliminating waste and fraud, and the guilty plea Musk cited shows that fraud within USAID was real, not fabricated.

The harder question is whether operational disruption caused by rapid program termination produced preventable deaths independent of whatever fraud existed. That is exactly what Khanna is demanding Musk answer in a congressional forum, and it is a legitimate oversight question, separate from whether anyone committed a crime.

Khanna's Move

On Monday afternoon, Khanna posted a video response. "The world's richest person has spent all day going after me," he said. "Why? Because I cited an academic study that his DOGE cuts may lead to the deaths of millions of children overseas." He challenged Musk to debate the humanitarian impact directly rather than threaten litigation. "You're not going to be able to intimidate me."

Khanna and Sen. Bernie Sanders have also been advancing a separate proposal for a 5% annual wealth tax on U.S. billionaires, according to The Deep Dive.
