What the Industry Is Actually Doing
Ticketmaster, which handles primary ticketing for a large share of major concerts, told CNBC it blocks automated software, identifies and shuts down fake accounts, and cancels orders that violate its policies. A company spokesperson acknowledged that "brute force bot attacks" represent only "one part of the battle" they are fighting — noting that scalpers operate as "highly sophisticated networks that strive to mimic human fan behavior to blend in."
David Irecki, chief technology officer at data software company Boomi, told CNBC that effective bot detection is not a single-switch solution. It requires analyzing patterns across user data: transaction signals, payment behavior, purchase speed, buying patterns, and credit card activity together. A bot that mimics human browsing well enough on any single metric can slip through filters relying on only one indicator.
The Supply-and-Demand Argument Deserves a Fair Hearing

Laws Alone Won't Win This
Sng himself was skeptical that policy would be sufficient. "Knowing humans, they will always find a different way [around the rules]," he told CNBC.
That skepticism is grounded. Bot operators are not passive — they adapt. When platforms strengthen defenses, bot developers update their software. South Korea's January expansion and China's April regulatory meetings are real steps, but enforcement against distributed, often anonymous software operations is technically and jurisdictionally difficult.
Boomi's Irecki underscored that point: "It's not just about one tool because you need regulation or business policy, but it needs to be supported again, by well-connected systems."
The Bigger Picture
The practical question facing regulators is whether existing frameworks — anti-scalping statutes, platform enforcement policies, bot-detection software — can keep pace with increasingly sophisticated automation. Meanwhile, the harms extend beyond individual fans. Hershberg noted that scalpers are the primary beneficiaries of ticket markups, rather than "the actual people who are putting up with the risk and the artists and other people working on the show."
